Animal waste must be properly managed and farmers in Alabama must adhere to certain rules and regulations enforced by the Alabama Department of Environmental Management (ADEM). Farmers are required to have a Comprehensive Nutrient Management Plan (CNMP) that describes their operation and how animal waste is managed.
Best management practices for animal waste production, treatment, transport, and proper disposal or land application must meet or exceed USDA/Natural Resources Conservation Service (NRCS) technical standards and guidelines. All CAFOs must register with ADEM. There is no permit fee to register your CAFO and AFO. AFOs are able to voluntarily register their AFOs with ADEM as well.
Any new or existing CAFO or AFO that will disturb more than one (1) acre of land must also seek coverage for the National Pollutant Discharge Elimination System (NPDES) Construction Stormwater permit. There is a permitting fee for this NPDES.
