Tennessee CAFO Rules and Regulations
Starting July 1, 2018, Tennessee no longer requires Concentrated Animal Feeding Operations (CAFOs) that are dry poultry or classified as medium in size liquid to obtain the State Operating Permit for CAFO. Large liquid waste management CAFOs and anyone that has received a Notice of Violation, regardless of size, are still required to obtain the permit.
Existing permitted farmers who will no longer be required to continue the coverage for their CAFO do have the option to continue or maintain their existing coverage.

If more than one (1) acre of land is disturbed, a National Pollutant Discharge Elimination System (NPDES) for Construction General Permit (CGP) is required.
Part of the requirement for the CGP permit is a Stormwater Pollution Prevention Plan (SWPPP) and an Erosion and Sediment Control Plan. Once the CGP is received and as soon as construction begins, twice weekly (bi-weekly) inspections are required each week until a Notice of Termination (NOT) can be reached after construction ends and the site is stabilized.
